• Account Registration: You must register for an account using your Gmail credentials. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Grant of Permissions: By connecting your BigQuery project to the Service, you grant the Service permission to access and query your BigQuery data on your behalf, utilizing the OAuth 2.0 scopes you have authorized. You acknowledge and agree that you are solely responsible for understanding the permissions you grant and the potential costs and consequences associated with them.
• User Conduct: You agree not to use the Service for any unlawful or prohibited purpose. You are solely responsible for the queries you initiate through the Service and their potential impact on your BigQuery costs and data.

4. Service Limitations and Disclaimers

• No Guarantee of Accuracy: The Service relies on artificial intelligence, which is not infallible. We do not guarantee the accuracy, completeness, or suitability of the SQL queries generated or the results obtained. The interpretation and use of the data are your sole responsibility.
• Potential for High Costs: The Service can execute queries that may incur significant costs on your BigQuery account. You are solely responsible for monitoring your BigQuery usage and costs. We are not liable for any costs incurred due to queries executed through the Service, including, but not limited to, expensive queries such as SELECT * or queries that process large datasets.
• "As Is" and "As Available" Service: The Service is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• No Liability for LLM Actions: You acknowledge and agree that the Service uses an LLM to generate SQL queries. We are not responsible for the specific actions or outputs of the LLM, including but not limited to unexpected, inefficient, or potentially costly queries.
• No Responsibility for Data Loss or Corruption: We are not responsible for any loss or corruption of your data that may occur as a result of using the Service. You are responsible for implementing appropriate backup and security measures for your BigQuery data.

5. Data Access and Security

• Access to Your Data: By using the Service, you acknowledge that we will have access to your BigQuery data to execute queries on your behalf. We will only access and process your data as necessary to provide the Service.
• Storage of Chat History: We store your chat history for the purpose of providing and improving the Service. You acknowledge and consent to this storage.
• Data Security: We will implement reasonable security measures to protect your information and chat history. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
• No Liability for Data Breaches: While we strive to protect your data, to the maximum extent permitted by applicable law, we are not liable for any unauthorized access to or disclosure of your data.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TALKTOMYDB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100 USD.

7. Indemnification

You agree to indemnify, defend, and hold harmless talktomydb, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
